1. Agreement
These Terms & Conditions (“Terms”) govern your access to and use of ThunderSaaS, including our websites, applications, APIs, and related services (collectively, the “Service”). The Service is operated by Silent Hill Labs, a sole proprietorship operating from Tirunelveli, Tamil Nadu, India. By creating an account, accessing, or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.
2. Accounts and responsibilities
You are responsible for providing accurate account information, keeping credentials confidential, configuring appropriate user permissions, and all activity that occurs through your account. Notify us promptly if you believe your account has been compromised.
3. Acceptable use
You may use the Service only in compliance with applicable law and these Terms. You must not misuse the Service, bypass security controls, interfere with its operation, access another user’s data without authorization, upload malicious code, infringe rights, or use the Service to violate privacy, safety, or regulatory obligations.
4. Customer content
You retain ownership of the data, files, records, and other material you submit to the Service (“Customer Content”). You grant us the limited rights needed to host, process, transmit, display, back up, and otherwise operate on Customer Content to provide and secure the Service. You are responsible for having the rights and permissions required to submit Customer Content.
5. Our platform and intellectual property
We and our licensors own the Service, software, designs, documentation, trademarks, and related technology. Except for the limited right to use the Service under these Terms, no ownership rights are transferred to you. Feedback you provide may be used to improve the Service without creating an obligation to you.
6. Plans, billing, and taxes
Some features require a paid subscription. Subscription prices, billing intervals, usage limits, and included features are shown at checkout or in your account. Annual plans are billed in advance for the selected subscription year. You authorize us or our payment provider to charge the applicable payment method and are responsible for applicable taxes, except taxes on our income.
7. Cancellation and refunds
You may cancel your subscription at any time through your account or by contacting us. Cancellation stops future renewals, and access normally continues until the end of the current paid subscription period.
For annual subscriptions, you may request a refund within 14 days of the original subscription payment. Approved refunds will normally be returned to the original payment method within a reasonable processing period. Refunds may exclude applicable taxes, payment-processing fees, or amounts already used.
We may update pricing or plan features for a future renewal period by providing reasonable notice. If a payment fails, we may limit or suspend paid features after providing reasonable notice where practicable.
8. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, fail to pay, create a security or legal risk, or misuse the Service. You may downgrade to the Free plan at any time, and the downgrade takes effect immediately. After termination, your right to use the Service ends, subject to the 15-day data-deletion schedule and any legal retention requirement.
9. Third-party services
The Service may rely on or connect to third-party services, including cloud hosting, payment processing, communication, storage, or integrations. Third-party services are governed by their own terms and policies. We are not responsible for a third party’s independent acts, availability, or content.
10. Availability and changes
We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, outages, security events, and events outside our reasonable control may affect availability. We may change or improve the Service over time, including by adding, modifying, or removing features.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. The Service is a business tool and does not provide legal, tax, accounting, financial, medical, or other professional advice.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our total liability arising out of the Service or these Terms will not exceed the fees you paid to us for the Service during the twelve months before the event giving rise to the claim, except where applicable law does not allow that limitation.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our personnel from claims, losses, liabilities, and expenses arising from your Customer Content, your misuse of the Service, your violation of these Terms, or your violation of another person’s rights.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, courts in Chennai, Tamil Nadu will have jurisdiction over disputes arising from these Terms.
15. Changes to these Terms
We may update these Terms as the Service develops. We will post the revised version and update the effective date. Your continued use of the Service after the revised Terms become effective means you accept the changes.
